The Consumer First™ Marketing vision

In 2000, a vision for a new marketing model was conceived out of the foundation of loyalty marketing - direct contact - while utilizing the potential power of a new technology that the founders insisted would turn conventional marketing inside out: the Internet. Rather than marketing the brand to the consumer, the new philosophy became to engage and identify the consumer with the brand. Thus, the modern-day Consumer First Marketing was born...

Consumer First Marketing was innovative and advanced with regard to both utilization of technology and marketing philosophy. Co-founders Larry Napier of Nashville and Woody Degan of Memphis, TN were both serial marketers, with Napier developing the marketing story, while Degan evangelized early adoption of, and focus on, the Internet as the central hub of operations, support, and reporting, thereby achieving economies of scalability by design. Within months of activation, membership quickly soared through the tens of thousands, to the hundreds of thousands, and then...the millions. This was still only 2003. Dial up modems, no broadband, no smartphones. The concept was brilliant. The first independent to add sky miles to a credit card. The math model was also innovative, allowing for commission depth to previously unseen levels.

There was only one problem: the Internet infrastructure was not robust enough to handle Degan's technological creations.

By late 2005, it was all over. The company couldn't execute the vision because the technology didn't exist...yet. The promise was there, but the security wasn't there, the batch processing wasn't , and data transfers were slow, inefficient, and often unreliable. And then there were the financial, banking, and credit card access issues... It would be still another decade before the Internet infrastructure would be adequate. As a result, the company sold its assets, databases, and released their independent marketers and support personnel. After a legal challenge that went all the way to the U.S. Trademark Trial and Appeal Board (the Supreme Court of Trademarks), Degan was awarded the United States Trademark.

The Tower of Babel. The executives of Consumer First Marketing returned to their distinquished careers in various concentrations of marketing - with their new vision and philosophy of engaging the consumer by utilizing the Internet as the concentric solution, and point of contact. Over the next decade, as technological advancements in the World Wide Web, Search and Information, Telephony, Connectivity, and Artificial Intelligence Technologies continued, those executives, professors, business owners, entrepreneurs, authors, and marketing community continued to develop the Consumer First Marketing model. The processes and methodologies Napier and Degan evangelized have been continuously refined and updated to achieve maximum effectiveness in identifying and engaging target-market consumers. The result of the cumulative effort is a model where solely utilizing the age-old models of demographic and geographic data is outdated. Building on those models through the use of data-mining, social networking, location, and personal interaction tools in order to identify an individual's buying patterns, habits, and preferences has proven to be a far more effective marketing strategy in gaining - and retaining - customers. That's Consumer First Marketing.

We manage IP, filings, updates, and in some cases, legal matters. We have represented several clients before the Trademark Trial and Review Board - the SCOTUS of IP - both as a Plaintiff and as Defendant. We have never been unsuccessful in representing the IP of any brand identity.
